These Terms of Use (“Terms”) govern your access to and use of the Drip Run mobile application, website, and related services (“Services”) operated by Drip Run Pty Ltd (“Drip Run”, “we”, “us”, or “our”). By using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Services.

1. Eligibility and User Accounts

To use Drip Run, you must:

Be aged 16 years or older (if under 18, you must have parental or guardian consent)
Have the legal capacity to enter into an agreement
Use the Services in accordance with all applicable laws

You may need to create an account to access certain features. You are responsible for keeping your login credentials secure and must notify us immediately if you suspect unauthorised access to your account.

2. Use of the Services

Drip Run is an augmented reality scavenger hunt game where users search for virtual objects (“Drops”) in real-world locations to earn prizes, points, and rewards.

You agree to:

Use the app safely and responsibly
Be aware of your surroundings at all times
Avoid using the app while driving, riding, or in unsafe environments
Follow all relevant laws, including traffic laws and campus regulations
Only access Drops in public or permitted areas
Respect private property and avoid trespassing or unsafe behaviour

You acknowledge that some features may be location-dependent and may not be available in all areas or at all times.

3. Prizes, Offers and Promotions

Drip Run may offer digital or real-world rewards provided by us or participating brands. These may be subject to:

Availability and location restrictions
Verification of eligibility (e.g. student status)
Expiry dates or redemption conditions set by third-party partners

Brand Responsibility:

Brands are solely responsible for ensuring that their promotions comply with Australian Consumer Law, privacy laws, and any required competition or lottery permits.
Brands must provide accurate information about products, discounts, and prizes.

Drip Run’s Role:

We do not control or verify brand promotions and are not liable for inaccurate descriptions, discontinued offers, or unfulfilled prizes.

4. Acceptable Use

You must not:

Harass, stalk, abuse, or harm others while using the Services
Engage in unsafe, unlawful, or antisocial behaviour
Attempt to gain unauthorised access to any part of the platform
Interfere with or disrupt the integrity or performance of the Services
Use bots, cheats, or automation to manipulate gameplay or leaderboards
Post false, misleading, or defamatory content
Infringe on any intellectual property rights

We reserve the right to suspend or terminate accounts that breach these Terms.

5. Intellectual Property

All content in the Drip Run app and website – including logos, artwork, game assets, and code – is owned or licensed by Drip Run and is protected under copyright and trademark laws.

You may not reproduce, distribute, or publicly display any part of the Services without our written permission.

If you create or tag content (e.g., photos, videos) featuring Drip Run, you grant us a non-exclusive licence to repost or feature this content for promotional purposes.

6. Location Services

Drip Run relies on your device’s location data to function correctly. By using the app, you agree to allow us to collect and process your location data in accordance with our Privacy Policy.

You can disable location services via your device settings, but this may limit access to features.

7. Safety and Risk

You acknowledge that using the Services involves real-world movement and activities.
You participate at your own risk and are solely responsible for your safety and the safety of others.
You must not enter restricted areas, trespass, or put yourself or others in harm’s way to access Drops.
You agree to comply with our User Safety Policy

8. Disclaimers and Limitations

To the extent permitted by law:

Our Services are provided “as is” and “as available”.
We do not guarantee uninterrupted access, engagement results, or prize availability.
We are not liable for any injury, loss, or damage resulting from unsafe behaviour, trespass, or third-party promotions.
Our liability for any claim is limited to the greater of AUD $100 or the amount you paid us in the three months prior to the claim.

9. Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or engage in unlawful, harmful, or fraudulent conduct.

You may stop using the Services at any time. To delete your account, please follow the in-app instructions under account settings.

10. Changes to These Terms

We may update these Terms from time to time. We will notify users of any significant changes via the app or email. Continued use of the Services after an update constitutes acceptance of the revised Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia.

In the event of a dispute, you agree to first attempt to resolve it with us in good faith. If unresolved, disputes must be submitted to mediation before commencing due proceedings.
